Property conveyancing is the legal process of transferring a property from the ownership of the seller to that of the buyer. Conveyancing in South Africa can only be carried out by a licensed conveyancer, i.e. an attorney who has passed the National Conveyancing Examination. There are a number of tasks that make up this process. A written contract must be drawn up first, and this contract needs to be agreed upon and signed by both the seller and the buyer of the property.
After an agreement of sale has been made, a conveyancer is appointed (invariably by the seller, who must also pay the fees) and instructions are sent to him by the estate agent, including the names of the buyer and seller, a copy of the agreement of sale, and the passport numbers and marital status of the buyer and seller. The conveyancer then drafts the necessary documents. Once this is done, the current mortgage must still be cancelled, title deeds requested and a clearance certificate must be obtained from the local municipality. Only after this has been done, can the new title deed be drawn up and used for the new bond registrations and registration of the property in the new owner’s name.
