Documents Required By Conveyancing Attorneys
Fixed property deed transfer is a complicated process, especially when there is still a mortgage registered on the property and when the purchaser needs bond registration services as well. At Bert Smith Incorporated we have an experienced team of conveyancing attorneys to assist with the registration of bonds, transfer of property and related conveyancing services.
The conveyancing attorneys and bank attorneys will require certain documents to complete the process of title deed transfer and bond registration. As such make sure as seller or purchaser that you have certified copies of marriage certificates, identity documents, and any marriage contracts ready for the conveyancing attorneys.
Other documents that will be required during the process are briefly described below.
Status Letter
The purchaser must declare marital status including any contracts, whether married in community or out of community of property and in whose name or names the property will be registered.
Power of Attorney
The seller must sign a power of attorney to give the conveyancing attorneysauthorisation to do the property deed transfer.
Mortgage
The purchaser must sign a document that gives the lawyers the authorisation to register a mortgage over the property for the purpose of securing a loan from a lending institution.
Transfer Duty
The seller and purchaser must sign a document stating the property value and there must be proof of transfer duties paid by the attorneys on behalf of the client to ensure that property transfer can be registered.
You can obtain a breakdown of the property registration and transfer fees from us to help you budget in advance. Our firm is represented on major bank panels including NEDBANK, FNB, STANDARD BANK, and ABSA. This ensures that the registration of the transactions can take place in a timely manner.
